NLRB Data: In May, the Union Win Rate in Certification Elections Remained At 80%

In May, unions continued winning a vast majority of secret-ballot elections conducted by the National Labor Relations Board (NLRB), according to recent NLRB data.
Overall, unions won 79 percent of all of the 151 elections conducted and closed out by the NLRB.
While unions did not fare as well in the 13 decertification elections, winning 75 percent of those, unions did win 80 percent of the 138 certification elections where the majority of workers chose to become newly unionized.
Although union win rates dipped slightly at the beginning of the NLRB’s 2023 fiscal year (which began in October), since February—when unions won 88 percent of all certification elections—union win rates have been near or above 80 percent.

With the addition of May’s win rates, unions have now won an average of 73 percent of certification elections since the beginning of the NLRB’s fiscal year.
As noted previously, while the union win rates through secret-ballot elections are certainly good news for unions, it also comes at a time when unions, as well as the NLRB’s general counsel, are seeking to effectively eliminate secret-ballot elections.
