In the first month of the National Labor Relations Board’s (NLRB) fiscal year, unions won a majority of certification elections in October, according to newly-released NLRB data.
Following a 91% win rate in September, the union win rate dipped to 73 percent for RC elections and 83 percent of RM elections.
While October’s RC election win rate of 73 percent was similar to the October 2022 RC election win rate of 72 percent, however, following the NLRB’s August issuance of the Cemex framework, which calls for employers to file RM petitions for secret-ballot elections if presented with a demand for recognition, there was a five-fold increase in RM elections (from one in September to six in October).
Although unions won the majority of certification elections, unions lost a majority of decertification elections—wherein employees voted to discontinue union representation.
It is expected that, due to the new Cemex framework, there will be more RM elections as time goes on.
