Opinion: Trump May Have Grounds To Fire NLRB Wilcox and Prouty Lawfully and 'By The Book' (But That May Not Be The Point)

The Short Version: Last week, a federal judge ruled that President Trump’s firing of NLRB Member Gwynne Wilcox without cause was unlawful. The ruling is a likely first step for the case to go to the U.S. Supreme Court. However, had Trump not have wanted the fight to go to the Supreme Court over interpretation of the Constitution’s Article II, the Administration could have used the steps outlined in the National Labor Relations Act to fire Wilcox, as well as NLRB Member Prouty, and may have been justified in doing so.
