NLRB Data: Union Win Rates Rose Again To Near 80% In August
Unions have won, on average, close to three quarters of all certification elections in 2023.
After dipping in July to 64 percent, unions won 78 percent of all certification elections in August, according to recently-released National Labor Relations Board (NLRB) data.
Additionally, the number of certification elections conducted and closed out by the NLRB increased slightly—from 102 elections in July to 108 in August—though still down from June’s 142 certification elections.
The percentage of certification elections won by unions since the beginning of the NLRB’s fiscal year is now 73.3 percent after dipping to 72.8 percent in July.

A Year-Over-Year Comparison
Although the union win rate for August 2023 was 11 percentage points higher than August 2022, the number of certification elections held in August was very close to the same month last year.
The number of decertification elections held in August 2023, however, rose by 66 percent over the number held in August 2022—from 9 in August 2022 to 15 in August 2023.
Although the number of decertification elections rose year over year, 74 percent fewer employees participated in decertification elections in August 2023 compared to August 2022—698 compared to 2693, respectively.

As September is the last month of the NLRB’s fiscal year, it is expected that the union win rate average will remain near 75 percent for FY2023.
